("we", “us” or “our”).

1.3 By accessing or using our website and additional services, Customer acknowledges that it has read and understood and accepted these terms of use and agrees to be bound by these terms of use and by our Privacy policy.
1.4 Please read these Website Terms carefully together with our Privacy Policy and, if you register through the Site, they govern our relationship with you.
1.5 We may revise, change, add or remove portions of these Terms and Conditions from time to time and the most current version will always be posted on the Website. All revisions will be automatically notifying on posting. It is your responsibility to review these Terms prior to each use of the Site and Services and by continuing to use this Site and Services, you agree to any changes.
1.6 We recommend that you print a copy of these terms and conditions for future reference.
2.1 In order to become a registered user of the Beyond Talent Recruitment Site you will be required to provide some basic personal information.

You acknowledge that, as between Beyond Talent Recruitment and you, Beyond Talent Recruitment is the sole owner of all content on the Site and Services, including, without limitation, all applicable copyrights, trademarks, trade names, logos, images, designs, articles, contents and other intellectual property rights.

4.3 In the event that you are found by us to have breached the terms of this clause 4, then we reserve the right to terminate without notice your use of the Site without limiting any other rights and remedies we may have.

5.2 Beyond Talent Recruitment also release information relating to you to regulatory or law enforcement authorities, if required to do so. We may use the information we have collected about you on an anonymised basis for the purposes of monitoring in relation to our equal opportunities policy. We also reserve the right to disclosure the information we have collected about you to our professional advisers and to other persons to the extent that Beyond Talent Recruitment contracts out any aspect of the operation of its recruitment agency services.
6.1 By providing information and Customer Content via the Site, Customer automatically grants Beyond Talent Recruitment a non-exclusive, worldwide, unlimited, sub-licensable and royalty-free right to share, copy, remove, keep, multiply, analyse, modify and adapt your data with any member of our group or third parties, both within the UK, EEA and outside of the EEA, for the purpose of our recruitment services as set up in our Privacy and Policy, in order to manage the Account. We will ensure your personal data is protected by requiring any group companies to follow the same rules when processing your personal data.
6.2 You acknowledge that any Submissions you make to the Site may be edited, removed, modified, transmitted by Beyond Talent Recruitment and you waive any rights you may have in having the material altered or changed in a manner not agreeable to you. We may remove your content from use at any time. We make no promise to store or keep showing any Submissions and we have no obligation to maintain or provide you with a copy of any Submissions (other than as required by applicable law). Submissions made to the Site may also be included in our CRM, and made available for reusing it through other formats.
7.1 Beyond Talent Recruitment’s provision of the Services and the use of the Website is provided on an “as is” basis without warranties that the Service will meet Customer’s requirements of any kind, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws of England and Wales.
7.2 We do not guarantee that the Site will be compatible with any hardware or software which you may use.
7.3 We do not warrant that the Site will be uninterrupted or error free.
7.4 Without prejudice to the other provisions of these Terms, neither Beyond Talent Recruitment nor its affiliates shall be liable for any direct, indirect, consequential, errors, inaccuracies, omissions, or other defects in, the information contained within the Site (including the reliance upon any such information), or for any delay or interruption in the transmission there of to you, or for any claims or losses arising therefrom or occasioned thereby.
7.5 Customer is solely responsible for the legality, accuracy and completeness of the Customer Content made available to and/or submitted to Beyond Talent Recruitment.
Customer agrees to indemnify and hold harmless Beyond Talent Recruitment from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to attorney’s fees) arising from (a) Customer’s violation of any term of this Agreement; (b) Customer’s use of, and access to the Website; (c) Customer’s loss of, or disclosure of, information gained from using Website; (d) Customer’s violation of any third-party right, including without limitation any Intellectual Property Right or privacy right deriving from the General Data Protection Regulation (EU) 2016/679; and/or (e) any claim that the Customer Content violates any third-party right and/or caused damage to a third party. This defense and indemnification obligation will survive this Agreement.
7.6 We will not be liable for any third party claims or any business, financial, economic loss or any loss of profit nor for any consequential or indirect loss (such as lost reputation or lost opportunity), whether foreseeable or unforeseeable, arising as a result of your use of the Site whether such loss is incurred or suffered as a result of our negligence or otherwise.
7.7 We accept no liability for viruses, and you are advised to take all appropriate safeguards before downloading information or images from the Site.
7.8 Nothing in these Website Terms will limit our liability for:
7.8.1 fraud;
7.8.2 death or personal injury caused as a result of our negligence; or
7.8.3 any matter for which it would be unlawful for us to exclude or to attempt to exclude our liability.
8.1 On receipt of an email by you to us cancelling your registration we will terminate your registration.
8.2 Beyond Talent Recruitment may, at any time at its sole discretion, terminate or suspend any of its obligations under the Agreement, without any prior notice of default being required, when Customer is in breach with these Website Terms.
9.1 Beyond Talent Recruitment request that all information included in your registration is accurate, current and complete.
9.2 All notices sent to you will be sent to the email address provided with your registration details (as updated by you). By accepting these Website Terms you give your consent to receive communications from us by email.
9.3 Personal information that you supply to us will be checked and/or save and storage from Beyond Talent Recruitment in accordance with our Privacy Policy. You agree that we may use the personal information supplied by you in accordance with our Privacy Policy.
10.1 The Site may include links to other websites or material. We are not responsible for content on any website outside the Site. Please see our Privacy Policy for more details.
11.1 Customer may not assign or delegate any of its rights, or obligations, under the Agreement without the Beyond Talent Recruitment prior written consent. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected. By entering into the Agreement, Customer agrees in advance with the aforementioned transfer by Beyond Talent Recruitment.
11.2 If you breach these Terms and Conditions and Beyond Talent Recruitment chooses to ignore this, we will still be entitled to use Customer’s rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
11.3 Beyond Talent Recruitment shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
11.4 These Website Terms (and any document expressly referred to in them, including the Terms of Sale and Privacy Policy) represent the entire agreement between you and us in relation to the subject matter of any Contract.
11.5 These Website Terms are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.
12.1 The Terms, the Website and all Agreements in connection with the use of the Website are governed exclusively by the English law and the parties agree to submit to the exclusive jurisdiction of the English courts.
12.2 All disputes between Beyond Talent Recruitment and the Customer arising out of or in connection with these Terms of Use, the Website and all Agreements in connection with the use of the Website are exclusively submitted to the competent court of England and Wales
